i can get the histogram away from the sides but how do you get it down when it spikes over the top of the screen?

when you say over teh top, do you mean to the right?
As how high it is only tells you how many pixels are of that tone.
Can you explain more.
Are you jpg or raw?
If it to the right it is better then to the left as you will have more detail. if it too far right you have over exposed it.

There's nothing you can do - the vertical axis is RELATIVE - and is generated by the algorithms which create the histogram.
The vertical axis shows the total amount of pixels at any brightness level.
If there are a lot of pixels at any brightness level then the histogram will shrink down to indicate this - in effect showing that one or more particular brightness levels are dominating the scene.
It doesn't mean that the scene is over or under-exposed - that is what the horizontal axis shows.
So basically don't worry about it - you can't alter it.
