If I was to do my own website or signature of 'Robson Photography' and there already exists a 'robson photography' ........am I screwed with keeping this name?

If i got the web addy of robson-photography ....would I have to sign that on my photos or could I use the robson photography without the -?

The web addy will also be included in the signature stamp

depends if you want to refer people back to your website when they see your pics?

I wanted the name of a website, and signature on my picture to be 'Robson Photography'

doing a google a robsonphotography.com exists

does that stop me from creating a 'robsonphotography.net/.co.uk etc'

and stop me having 'Robson Photography (with my website addy underneath) signatured onto my pictures.

you can have .co.uk .net etc.......... have you tried to see if these are available? If so .. nab one!! :D

he has taken .com and .co.uk

net is available.

So if I took that, does that allow me to keep my stamp as

'robson photography
www.robsonphotography.net 2010'

Yes of course.. you can CALL your business name anything you like.. as long as its address is as you have put it.. the one that you take, ie, net.

There shouldn't be a problem, the problem comes when people look for your stuff.
.com is much more typical, then perhaps .co.uk and .net - although I did hear changes were going to be made to the MANY .tags available!?

Perhaps use your initial or some variant rather than taking one which may lead people to the wrong place. Its your choice of course.

I would also consider the area they work in... If they're in a different country, not a problem, if they're in the same county/area, more of a problem if people think they're on your site, but really on theirs.

Could cost you some business that way?

There's also the issue of "passing off" if he's in a similar area to you, where you'd he might consider you to be trading off his name. Unlikely, but worth considering.

I'd go for something different like Robsonphoto.co.uk, then use Robson Photo as a stamp instead.

It's more the issue with losing customers because they thought they were on the right site that would concern me though

As McDonalds have found to their cost, you can't stop someone using their own name in connection with a business. They are constantly trying to close down anyone called McDonald who dares use their name in connection with a fast food business.

They've also tried to assert copyright over every word beginning with the letters "Mc"

"if someone used the Mc prefix, even unintentionally, they are using something that does not belong to them"....

The only problem with having the same name as someone else is losing business by customers not being able to find you. There is no issue with having 2 Robson Photography's.

I'm really not surprised a common name has already gone as a domain name. I think I first registered my name about 10-12 years ago, plus the wife's company names. I didn't want to use my name for my photography website so picked on a location based name instead.

If you want to use your name you'll have to be a bit more creative

Also has the existing RobsonPhotography been registered as a trademark or business name, that could affect your decision.

Why not have...

www.robsonphotographic.com -or-
www.robson-photography.com

instead? Both are very good domain names!
