Media using photo... (again)

Yes
Following the death of a close friend 3 years ago, I gave her family copies of the photos I had of her. One of these was passed to the media, presumably by the family, to go alongside the 'news article' (It doesn't seem right calling it that but still...)
The articles, and photo are still live on a selection of local news & bbc page.
I'm happy for the photo to be used although I am planning on sending a email asking to be credited.

I am aware I could try sending an invoice, (some would say I should), but I will not drag her family into a copyright dispute. (And I'd need to call the tax man etc...)
That said, hypothetically:
If someone were to invoice for unauthorised image useage after a third party supplied the photo. Could and would the paper make a claim against the person who submitted it?

Unlikely - it's the publishers responsibility to ensure the picture is available for publication. It also depends how it was submitted - readers pictures etc - read the T&Cs.
