Clamping cars as a last resort

No, but I would know if the were or were not by seeing them, the question to be asked is would you or the OP. I would want to know what liabilities I had opened myself up to. Employing clampers is a risky business...

Clamping cars as a last resort

See post above. Can you also confirm that the signs and receipt issued were lawful in you defence? I have not seen many that are...

Missed that post, I did scan most of the thread ;) However experience says that my other points stand...

Clamping cars as a last resort

Well it seems that your well vetted clamping company has already acted unlawfully by clamping a disabled blue badge holder. It is not only contrary to the terms of the SIA licence but it is contrary to statute law and subject to prosecution. Contravening the terms of the licence is a...

    Fake debt collector advice

Either ignore everything unless you receive properly stamped county court papers, in which case you must respond or you will get a CCJ by default. Or send one letter. Put it in writing to them that you have no lability as it is not your dept. State that you will consider any further contact...

    Now THAT'S customer service!

You are wrong. The SoGA makes the retailer responsible, for the first 6 months the burden of proof lies with the retailer after that it lies with the customer, claims can be made against the retailer for as long as a hypothetical reasonable person would expect the goods to last. For an...

I've seen it all now (Footy related)

Also fails as the meat and two veg were suitably obscured by the suspenders panties and a bra. Being a prick is not the same as showing a prick ;)

I've seen it all now (Footy related)

I don't believe a breach of the peace is an indictable offence, if correct a citizens arrest would very likely be an unlawful act itself...

    Inconsiderate Parking

I got a Parking Charge Notice from Euro Car Parks at the Princess Royal Hospital Farnborough last week for being parked outside of a marked bay. There were no spaces available. I will ignore it and in time after several letters from the PPC and associated debt collectors to my employer, the...

    Inconsiderate Parking

Mmmm... Apart from the wheelchair icon looking like it has been stuck on as an afterthought, it complies with the TSRGD. Thanks for satisfying my obsession curiosity.

    Inconsiderate Parking

Another very grey area, but as a general rule of thumb: If legitimate enforcement is in place by virtue of the the railway bylaws, bylaw 14 iirc then parking restrictions can be legally enforced by means of Fixed Penalty Notice. These tickets will quote the railway bylaw under which they are...

    Inconsiderate Parking

Just out of interest Mike, what is the exact text on the upright sign in the disabled bay? It is hard to be sure from your photo but to me the sign does not look like it complies with the Traffic Signs Regulations and General Directions(TSRGD) 2002 diagram 661A.

    Inconsiderate Parking

Absolutely, I certainly do not advocate the abuse of a bay that is provided for the use of disabled drivers. Parent and child bays however I consider fair game ;)

    Inconsiderate Parking

Yes. My field of expertise is pretty much confined to Civil Enforcement law (parking, moving traffic contraventions and bus lane enforcement) so I'll not stick my neck out and say for definite which law would be broken, but I am sure an inventive copper could come up with something. As a...

    Inconsiderate Parking

Assuming the "disabled bay" at the fast ford place was in a private car park, as I stated in a previous post, it has no basis in law and is not in any way shape or form enforceable. Well other than by the issue of an unenforceable invoice under contract law or a wheel clamp that can be...
