Yes
I was having a look through my flickr stats and found one of my images was being found on footy247.co.uk

Having gone through 61 pages of images I found mine. It says it was uploaded to flickr on 26th October at 8pm by myself. A click on the image or my name links back to my flickr page.

I have scoured flickr and cannot find any link with them and footy247.co.uk and as I uploaded the image as All Righrs Reserved I assume that this website has stolen my image the minute it was uploaded to flickr.

I found some others on there that even still had other peoples watermarks still on them !!!

I just sent off an email advising them they are using my photo without my permission and requested they advise me of the name and address to which I should forward my invoice ;)

I think you'll find this covers it.

It's the same with all Photo and Video upload sites.

Thats from Yahoo Groups, not Flickr.
(Yes I know Yahoo own Flickr, but if Flickr had those terms giving Yahoo carte blanche with all uploads, there would be a huge outcry)

8. PUBLIC CONTENT POSTED TO YAHOO!

(a) For purposes of the TOS, "publicly accessible areas" of the Services are those accessible by the general public. By way of example, a publicly accessible area of the Services would include public Yahoo! Groups, Yahoo! Answers and Yahoo! Message Boards, but would not include unlisted Yahoo! Groups or private Yahoo! communication services such as Yahoo! Mail or Yahoo! Messenger. You acknowledge that you are solely responsible for any personal data or information that you choose to disclose and make publicly accessible via the Services, and that under no circumstances will Yahoo! be liable in any way for the disclosure and public accessibility of such personal data or information. You acknowledge that any personal data or information (or any other Content) posted to publicly accessible areas may remain publicly accessible indefinitely.

No mention of work uploaded onto Flickr.

How can I copyright my photos?

In most parts of the world, including the U.S., Canada, EU countries, and Japan, you are automatically granted copyrights to your photos.

However, the nonprofit Creative Commons offers six default licenses as an alternative to full copyright so you can choose the one that best suits your needs.

Remember that you can only copyright images that you own. This means you can't copyright images that you've taken from somewhere else! Additionally, just because an image does not have a Creative Commons license attached to it, doesn't mean that it is public domain.

You can select a default license for your photos here.

To add a license for a specific picture, click the "Change" link next to your current photo license (usually set to "All rights reserved") near the bottom of your photo page. On the Privacy and Permissions settings page, click the "Add a license to your photo" link on the right side of the page, near the bottom. On the next page, select one of the Creative Commons licenses.

We offer the ability for you to associate a Creative Commons licence with one or all of your photos. You can find out more on this page.

If you see your work in someone else's photostream, please submit a Notice of Infringement to the Yahoo! Copyright Team. Information on how to do this correctly is here, and there's a link in the footer.

What i do to try and avoid this is the obvious watermark.

If you use Lightroom it is dead easy and makes pics that bit more difficult to steal.

I see the t&c's quoted were for Yahoo and gave yahoo access to the images to use to promote the group not give away to a third party to do what they want with. On flickr I can't see anywhere in the T&C's that gives a third party website any access to content you upload to flickr that is covered by your own copyright.

Other images already have watermarks covering them. Some cover the whole image but that hasn't stopped this website taking them and using them on their own website.

The Yahoo groups T&C has nothing to do with Flickr T&C which has clear elective licensing. If you selected all rights reserved then go kick the photo stealing ******** in the nuts.

I agree. If the original quoted text was true then it'd make the licensing facility in Flickr redundant.

Did anyone else go and look at Flickr's T&Cs? The original quoted text from Pete Allen is there! People should learn to check and read things before they dismiss them

It just failed to quote section (a) where "publicly accessible areas" is defined, if you read my previous post you'll see

A similar thing happened to me on Flickr last year. :(

You can see my thread here.

I got in touch with Flickr, and by sending them a copy of the original, they removed my image from the company's Flickr page.

I was quite busy at the time I found out, and after a bit of preposterous posturing on their part, they removed my pic from their website before I could take any more action.

Couldn't be bothered doing anything else. Funny thing is, if they had asked, I probably would have let them use the image. Instead they were d**ks about it.

Got a reply from the website which is as follows:

"Hi Andrew

What are you talking about, we aggregate *public* images from flickr
tagged Liverpool. They are small thumbnails linking back to the
original source which is more than acceptable in my opinion.

If you don't want your images to be used don't put them on flickr?
Maybe you should be speaking to them about why they appear in an
public RSS feed.

Also provide me with the full path to any of your images I will
happily remove them all

Regard"

Even more confused now !?!

If I don't want my images used don't put them on Flickr ? FFS - So I can take anyone's photo on flickr and use it any way I want and when they challenge it I can just say "if you don't want it used don't put it on flickr" !?!?!?!

And why would my photos on flickr with all rights reserved appear in a public RSS feed ? confused about that point.

What would you do next ?

Did you not know about the RSS feed on Flickr? I susbscribe and it does effectively post out the images to my mailbox :)

Most interesting debate potential (though I know it'll degenerate into a "rights grab" grumble instead).

To answer your question: I'd have a proper look, myself, at the Flickr terms. Then I'd clarify them with Flickr and then decide what to do.

IF I turned out to be in the right I'd be a bit more foreceful with the nice chap(ess) at footy whatever and ask the nice folks at Flickr to have a word too.

IF I were in the wrong I'd say no more about it and consider not using Flickr anymore if it bothered me that much.
