Canon 5dmk2 w/ 70-200 problem - warranty..?

Hi guys

I'm not convinced my 70-200 2.8 ISII is working correct, it appears to backfocus at 70mm and isn't always great at 200mm. Background OOF areas aren't as good as at first and it's nowhere near as sharp as when I first bought it. It's NOT had a fall but does have some scratches on it from general use. It was bought new on March 18th 2011. Would Canon still service it under warranty or would they flag up the scratches straight away and say that it's my problem? Either way it will probably get sent off but i'm just wondering what peoples experiences are.

Also daft question but is it possible for my 5dmk2 to not focus properly? I'm starting to think it may be that as my lens is MUCH sharper on my colleagues 5dmk2 and doesn't back focus at 70mm on things past infinity.

did you get your 5d 2nd hand, is there any micro adjust set on it?

I mean scratches on the barrel, lens is perfect. No micro adjust set.
 
If anyone has any suggestions for attempting to micro-adjust a 70-200 i'd like to give it a go. My problems are more exagerrated past infinity.
