Does the ETTL only work when the flash head is at 90 degrees. As soon as I move the flash head to bounce it ie 45 deg or straight up it doesnt seem to pick up the lens. ie it doesnt show 50mm

This distance data isn't used for bounce flash unless you use an off camera cord...the distance data will then be used but is likely to be invalid unless you keep the distance and direction correct....if the distance/angle is wrong then the exposure data will be incorrect to some degree.

ok, so fill flash using ettl is only effective when the flash is on the camera at 90 deg pointing at the subject to be filled otherwise the flash/camera wont be able to assess the corrct flash exposure and compensate for the background/ambient light

That's what it does on mine (same set up) only uses the distance data when it's pointing at the subject.

on a slightly different note, is there a specific setting for fill flash on the 40D or does the camera just workout if its lighting the whole frame or just filling in the subject?

No. ETTL is still active providing ETTL is showing on the flash rear screen. All that doesn't happen when you move the head away from 90 deg is the flash servo won't adjust the flash head to zoom to match the lens. This is because the flash has no idea how far the beam has to travel when being bounced before it reaches the subject. This also means you may not have enough flash coverage or you may be wasting flash coverage.

It does a good attempt at doing it automaticaly.

If the auto gets it wrong just use the flashes built in exposure compensation feature
