I would like to take some nice close up's of birds in my garden would the sigma be a better lens.I cannot afford to own both!
As you can tell i am a novice

I think the Sigma lens is probably not 100% compatible with the D40, since the D40 needs the lens to have the autofocus motor built in. The Sigma abbreviation for a lens of this type is HSM.
Here's a link to the Sigma page concerning D40(x) & D60 compatability http://www.sigma-imaging-uk.com/quicklinks/HSM_lenses.htm
and among the lenses labelled HSM is one labelled as the one you listed, Sigma 70-300mm APO DG. Best bet is to contact the seller and check that it is suitable for your D40, ideally at first hand, by trying it for yourself!
It seems to get a decent write-up. As PsiFox says you can get the Nikon lens with VR for about £100 more, secondhand, but for the money it doesn't sound as if you can go far wrong with the Sigma.
