Need some advice about a photographer

Not quite sure on this one but here goes...

My friend's sister got married in abroad (where they are based due to work) and had another celebration back here in the UK.

The photographer they used was Jet.

As you'll probably and immediately suspect, they weren't exactly happy with their photos. Although they didn't want to spend very much on a photographer (contrary to my friends recommendation), I told her you get what you pay for.

In retrospect there are some very good photographers here who charge a similar amount if memory serves correct, so perhaps they didn't get what they paid for?

Anyway, moving on because that's not the main issue. What they are really unhappy about is that he's got all their photos displayed in the download's section in low-res for choosing which prints they want (which is none btw, the groom has now got the originals to clean them up himself).

However, they were told this area would be password protected etc and they feel that this guy is playing on the fact that the bride's dad is quite famous - based on the fact that he is using her maiden name which has obviously now changed.

I've said that the copyright belongs with him for using photos in a portfolio as there's been no reassigning of copyright etc, however, what do you think on the low-res pdf sheet being available to the public against their wish and also the using of her maiden name?

Any thoughts?

aren't your friends better of contacting him directly and asking hime to rectify?

My first thought is that if they are unhappy that the photographer is using their photos in this way then they'll probably be unhappy that you are linking to the photographers site for them to get even more hits on the site.

Other than that, the photographer owns the copyright so he has the right to display the images in his portfolio.

Unless the photographer signed over copyright or agreed in writing not to display images on their website then they don't have a leg to stand on.

I have written specific contracts for people who didn't want their images to be used at all but then I was compensated for doing it for them :) (It's a shame because they were cracking images! lol)

The couple live in China so the bride's sister (my friend) is dealing with this. I'm not involved other than her asking me for some advice.

To reiterate, there isn't an issue with their photos being used in a portfolio and isn't about the photographer's rights on copyright which everyone seems to be focusing on - and I also have the same stance on this anyway.

It's about the low-res downloads section being openly available (and only theirs) and that he is not using her correct name. I've just been told that they believe they do have it in writing that he should be using a password so it doesn't really matter now.

Was just looking to see what others thought about it but the main point seems to have been missed. I've leave her to it.

As Kipax has just said, if they have it in writing then quote that back to the photographer and the issue should be resolved.

nothing you can do unless you have a contract that says so.
