I registered here just to ask this one question, I hope this is in the right section.
I just wanted to know if it's illegal for a teacher to take a picture of a student in high school? and are there different circumstances?

Just found out it was the teachers personal camera if that matters???
Oh and yeah I tried googling this and couldn't find anything..

Illeagal - No
Stupid - yes
breaking terms of contract - possibly

Thanks for the reply, my girlfriend isn't on great terms with said teacher(he tried getting her suspended) and has even been rude to her mom. My girlfriend is really upset about it at this point. Thanks again.

I think it would depend very much on the circumstances, if your friend was in the middle of committing a crime I don't think she'd be able to complain. If on the other hand she was on the toilet......

You're based in the US? If so I'm not sure if the law is the same as it is here.

In todays climate of correctness, I think its very foolish, some parents get very shirty if you photograph there kids playing football in the local park, and thats legal. I think if said pupil visits headteachers office and asks if he could ask the teacher to delete the image, and also ask the head to mention he/she feels uncomfortable with being photographed, the situation could be easily resolved.

If the photo has been taken within work premises then it would be subject to the data protection act and therefore need permission from the parents, which may have been granted when the pupil first started by an 'internet form' or similar. The photo would also be the property of the high school, and as such, you could legally ask for a copy. It would be hard in my opinion to argue that it was taken in a personal capacity. If taken on public property outside the school gates its personal property and not subject to the data protection act.

Yes in the US. She was in the hall getting a paper for a class she was in a few doors down(the teacher in that class gave her permission to go get it). He took the picture and told her she was going to get suspended even after she explained it to him. She just doesn't feel comfortable with this teacher having a photo of her on his own personal camera.

so was the photo intended as proof of truancy or something? Sounds like a right can of worms :(

What age is your girlfriend/student? Are the students not meant to be out of class wondering around at a certain time? It seems there's a bit of bad blood between them...:boxer:

Yes it was, even though there were no rules being broken.

My girlfriend is 17, At first he asked her where she was going. She said to get her paper in her locker, that she accidentally forgot and that her teacher at the time let her get. Then he proceeded to take the picture and told her to have fun dealing with her suspension.

Honestly I don't think anything can be done, but she's going to tell her mom about it and bring it up to the school.

From what you've said I doubt very much whether the school would agree to suspension. Here in the United Kingdom its getting harder to suspend pupils and the decision would be made at a senior level, and possible the chair of govenors. Often teachers try to use a scare tactic as they have very little powers over their students.. and it often works because of the pupils lack of confidence and experience in life.
