Refund from a badly designed website, whats the law say ?

Not sure if this is the right place for posting this but if not can a nice mod please put it in the right place :)

Anyway i'm wondering how the law stands on purchasing a website that doesn't do what it says on the tin, is it the same as normal purchases, are you covered on your CC, the company are based in the czech republic (only found out 3 days ago) i'm guessing there will be a lot of proving involved as it's not like taking you purchase back to the shop, but their must be laws covering this sort of thing, your thoughts or expertise would be greatly appreciated, many thanks in advance.
 
If you've bought the website from a czech company then I'm not sure if English law will apply so the answer may not be that simple.

I'd recommend a call to your credit card company to see what their policy is if you think that is your best chance of getting a refund.
 
You need to be more specific as to the problem... It has to be somehting that doesnt actualy work or is missing from the original design...

Well i basically purchased the normal template, but had two custom designs added based on another design from another website, on the other design it works perfectly on mine it doesn't, i'm sure it can be easily rectified by them, but their not answering my emails and i'm starting to get seriously brassed off, i only actually had two extras put on, one works (after they rectified it) the other still doesn't, and in the process of fixing the first one they have cocked up my customer shopping cart which now doesn't work ethier :annoyed:
 
What sort of timescales are we talking about with all this? I'd say initially they should be allowed reasonable time to sort any problems but if they are taking the biscuit then it probably is a case of not receiving the product you have paid for.

I guess the best relation to this could be computer games, whereby more often than not they have flaws at the time of release (especially the online aspect) and customers have to wait for patches to be released to fix it.


Also, I'm not sure if the Distance Selling Regulations can be used here as although I'm sure some time has passed, you've not technically received the final product and therefore the contract isn't complete. You would have to read up on it regarding this though. One problem may be that the DSR doesn't cover B2B transactions and you did mention a shopping cart. Could be a gray area.

this is not defend the website suppliers but sometimes remodelling a site can be harder then starting from scratch.

1) are they suppling the web space for you.
2) have you seen the addons on a website done by them

Sorry to hear you're having problems with them Tel, there was something about them which just didn't sit easy with me, hence me deciding not to go with them. However, I would at least give them a few days, bearing in mind how many websites they've sold I'd guess they have a pretty large amount of queries and amendments to make on a daily basis. How did you pay for it?

I paid by CC Dave, and taken some advice so if push comes to shove it maybe ok to get my money back, having said that i spoke to one of there customer service about an hour ago got him to get the site up the same time same so we were both looking together, and he could then see what i mean, and he agreed their was a problem, so he is getting the design team on it, hopefully as i type, he just called me but i missed his call, but he left me a message to say he's on the case, so hopefully it will be resolved today :)

1 If that means are they hosting it, the answer is yes
2 yes i have, and they work perfectly.

I'm hoping it will be resolved today, tomorrow at the latest, and if it's not i'm taking further action.
