I am looking for clarification regarding the use of flickr images downloaded from the web. I am a sports photogragher and am now branching into videography and still photo animation. Recently I used flickr to download sports sequence shots to add to the limited ones I had taken and I now have a finished film containing stills from flickr. I have tried to credit all photograghers and have had limited success trying to contact all of them to ask permission to use their work in a creative capacity. The film will be used as demo reel to show other clients the results I can achieve and I will not profit from the downloaded images other than securing further work. I am aware of the creative commons license that flickr has availiable but not all the images I used are covered by this.

The film is now finished but I am reluctent to upload it or show it to clients before finding out first if I have gone about this the right way.

Any advice would be apprieciated.

Where images are marked as rights reserved you have no right to use them in any capacity without their prior consent. If the images are royalty free then you should be ok using them in your reel. Until you have permission for every image with rights managed you use you shouldn't show it to anyone.

In basic terms, don't use anything until the author says you can.

You can't use royalty free without asking and paying either. RF means you pay based on the quality of the file, so therefore cheap if you're using it for a huge project. RM means you pay based on usage. At least in my experience anyway.

All images I used were covered either by a creative commons license or royalty free, I steered clear of any that stated rights reserved.

As I said I have had limited success in contacting the owners of all the images but have tried to include them all in the credits and have also mentioned that some of the images used came from Flickr.

When originally sourcing images I was prepared to pay for them and expected a window to pop up when I tried to download a high res version of the original image. This didnt happen, it allowed me to download the image both without asking the owner and without payment.

I now just want to clarify that I can use these images in a 3d animation even if I cant get a response from the owner.

I will not profit from the downloaded images other than securing further work.

I am not sure what the LAWs are in your country, but the fact that you are using the images to secure work, means you are using the images in a commercial capacity.

I would think you should wait to have expressed permission from all photographers before using the film in any promotional capacity.
