Website unauthorised use of my image

There is a website which has saved one of my images from flickr and uploaded it to their own site. They have left my url across the image and credited my website and the source of the image. My flickr has always been set to "all rights reserved" from day one. Since this website is a blog about time shares, I am wondering if they should really be paying me to use that image as no doubt they are making money out of it in some way. The image was posted on their website in November 2010 so it has been up there for about 9 months.

Is this something I could invoice for or do I have to grin and bare it because I have been credited for the image? this is the website page that it is on

foreclosedtimeshare.com

This is the image on flickr

Any advice gladly received.

Or you may be happy with having free advertising for your images?

I had one of mine used by a newspaper a few months back. They didn't credit me though so I sent them an invoice, which they paid

Like everyone has said your well within your rights to bill them, whether they pay up or not is a different matter. What's the website, is it a big company or just someone's blog? there's a whole load of things you can bill them for especially if they have printed your image and used it on the internet. I think it all depends how long they have been using it. The longer the better because it means more £££ coming your way.

There's loads of threads on here with this happening with some good advice too.

I've seen this website being linked before for this sort of thing http://www.londonfreelance.org/feesguide/index.php?&section=Photography&subsect=Online+use+of+photos

I don't fully understand it myself but i'm sure there's people on here that can explain it

Taking screen shots seems to be advice given out as well in case they remove it before you 'get um', you've got evidence.

Good luck

I suppose because I have never actually done this before, I am a bit wary of being in the wrong and making a tit of myself. The image is on a blog, which is linked to another website which is a timeshare sales and letting agent. The site the blog is linked with is redweek.com which is a paid membership site. Not sure what category their usage comes under for billing, commercial and business or advertorial and newspapers? my instinct would be the commerical and business. I will edit my original post to take out the link to the page. I will get the screen shots tonight and read through some other posts to try and find out how to do this. I better get myself some sort of invoice template to email too.
Thanks for all the suggestions posted. If anybody has any other advice, i.e. avoid doing so and so or whatever, or common ways people might try to get out of paying for such unauthorized use, please share them as I would like to be more aware of how to do this and what to expect. :)

if its a site for making money then send an invoice but if its someones blog just email them and inform them of what copyright is.
