Well I received my used Sigma 30mm f1.4 and gues what

whilst this message is polite and quite professional it's hardly offering to resolve my complaint
more a polite stuff you it was about the right price anyway and I needed the money for my holiday

The shop who were going to trade it in, which I wish I had done now as I'm frantically trying to get holiday stuff sorted as we speak and make sure I've got everything to go as I'm working long hours tomorrow to get the extra day off I needed. As I'm going to be away there won't be anyone here to accept a parcel. This is what I would have normallt suggested. The noise u mention is a standard noise as purchased, no need for me to mention as my mate has identical lens and same on his, think we even bought around same sort of time. I didn't really want to refund anything as its a fully working lens, I've had photos put into magazines with that lens up until I stopped using it in july. I isted it at £100 and I wasn't sure what it would go for, just needed the money for the trip. The shop said to expect it to go to 150 to 200 in that conditon and that anyone buying will no they are not buying a new item considering the cost brand new. Maybe try the lens I had no issues with it

Apologies, didn't read all the detail and thought you were resolved.

Doesn't sound so good then after all. An eCheque is when they don't have funds in their Paypal and their Paypal is not linked to a Bank Account via Direct Debit I believe. They are a pain!
 
so the money I paid by pay pal the day before into his account was gone
why would you not have a linked account mine is sounds dodgy to me

I could post all the correspondence but it would be an epic read and you'd all get bored lol
am I the buyer really interested in the fact that he needs my money to go on holiday
the fact that his cat has clawed the furniture, his girl friend is pregnant by his best mate and she has left him to live with her lesbian lover
his parents have disowned him now he is about to be made redundant ...............

I think this is the bit that is open to interpretation. There is dishonesty and there is genuine error. I sold a laptop on ebay some time ago that had a faulty enter button that I had no idea about so it wasn't in the description. The seller could easily have interpreted that as me trying to pull a fast one but it was a genuine oversight on my part and I offered a full refund and an apology. These things happen, we're all fallible but I believe we should be judged on how we rectify these situations.

Remember as well that there are an awful lot of buyers out there who stitch sellers up with phantom faulty items (I've had a few of those!) so you can sometimes understand a reluctance on the seller's to immediately commit to a buyer's requests.

Just saying how I see it.
 
some images of my current ebay sigma purchases everything on the 50mm side came with it filters strap etc slight difference in lens quality and condition wouldn't you agree

looks better in the pics and the state of the lens element is hard to show on the pics
remember it was described as having a slight scratch on the lens nothing about the nice crack in the focus window
it is alot rougher than the images show
I accepted the crack and the finish roughness for the price, it was the sate of the front glass that got me, one slight scratch, my bottom
looks like it has been bouncing around in his bag with other lenses on top of it

Ive bought 3 lenses from ebay, 2 of them i was paying a bit of money for so waited for several months until they came up within easy driving distance of my house, IE within 30ish miles. The petrol being worth spending money on to take out the worry of getting something in the post i wasnt happy with.
Both times (100mm and a 70-200) i meet up with the seller, had a look at the lens, quick chat and was more than happy with what i had purchased. For me its the best way to deal on ebay with pricey items.
 
Worth noting that if the seller has a business account your entitled to a 7 day refund under the distance selling regulations - article 11.2 of http://www.legislation.gov.uk/uksi/2000/2334/contents/made :rules:

My understanding is that this supersedes ebay regulations (which do also state your entitled to 7 days), its worth being really specific when requesting a refund, I.e. list the article and paragraph of the regulations when contacting both the seller and paypal - there's no arguing with it. Also contact paypal early on - if the seller stalls you to get beyond the 7 days, your stuck without a paddle!

You could also argue the seller failed to provide "a description of the main characteristics of the goods or services;" article 7.a.2 of the distance selling regulations. Especially as you requested photos which weren't provided.

If its a private sale (i.e. non business account) you arn't protected by distance selling regulations. However you can still file a "not as described" claim with paypal. Again, if you do your research into the paypal regulations, and actually quote which articles your referring to then your more likely to get it accepted.

(I try to avoid buying from non business sellers on ebay, had too many bad experiences fighting for a refund by someone trying to pull a fast one!! :wave:)
 
I would definitely left negative feedback as I believe he was not honest with the listing
Even tho you got the lens in the end for a reasonable price
But this happened because you did not want the hassle of sending it back
he was not honest with the listing and the next person who buys from him needs to know
