What exactly does this mean

Hi all

My daughter wants me to submit a picture of our moggy for a competition in the local newspaper
I know absolutely nothing about copyright, but I do know from here that some publishers take liberties and would hate to deprive someone of their rightful income, so is this the normal wording for such things

TERMS & CONDITIONS

Your details may be used by Cambridge Newspapers and Trophy Pet Foods to let you know about future opportunities but will not be passed on to third parties.

If you would prefer for your details not to be used in this way, please write the words ‘NO CONTACT’ at the start of your email.

If your photo also includes a person, ensure you have their permission to send it to us.

By sending us your picture, you agree to it being published and confirm it is not subject to copyright.

Thanks in advance for your advice

They need to make sure that you own the copyright to the picture, so that another tog does invoice them for publishing it. They ask for permission to publish, so they can show the picture in the paper.

They are not asking for copyright, or for image rights, so I think it is fairly standard, I wouldn't have an issue with it.

Thanks, seems they are acting in good faith then, was just concerned the pet food company was looking for free images to use for advertising purposes

I read that differently personally.

If you confirm that the photo you send them isn't subject to copyright, you then can't claim copyright on it when Trophy Pet Foods start using it for their next advertising campaign.

By all means confirm it is your photo, but don't confirm it as being free from copyright.

That's one incredibly badly worded set of Terms and Conditions which is left open to multiple interpretations.

Is that it, or do they go into further detail?

Everything is subject to Copyright, even your picture of Moggy. It is your choice as to what is done with that copyright, think of it like anything else you own. You can leave it in a dusty cupboard, or lease it.

I would personally contact the paper and ask what they would be doing with the photos just to ensure there is no ambiguity as from what you've written, there is no limit on where it can be published (it could be a book, on a website, in a newspaper) and there is no limit on the amount of time it can be published for. Because the agreement is so ambiguous, the paper could well argue they can do whatever they like with the image you submit to them. Including running an advertising campaign (which would be publishing the image.)

I'd also like to point out that even if you submit your image, you can always revoke the license granted to the newspaper as long as you ensure you are not handing over your copyright (which the above doesn't say you are doing).

Just sent them this email

Hi

Can you please explain the last sentence of the terms and conditions of your pet photo competition

"By sending us your picture, you agree to it being published and confirm it is not subject to copyright"

Are you asking me to declare that I own the copyright or that Cambridge Newspapers and Trophy Pet Foods can use the image without infringing my copyright

Thank you

Sorted and nothing sinister going on as this reply confirms

Thank you for your email.

We are ensuring that the person sending the photograph took it themselves and is happy for us to publish it without payment.

Many people, of course, pay a professional photographer to take photos of their pet and we could not use such an image without the photographer's permission.

Any image supplied will not be used beyond publishing it in our publications and/or websites.

Hope this information clarifies things.

Best wishes.
