I think the joke is the use of the word "shoot".

So he's asking what if he shot someone without their knowledge. Meaning photographed them but then he's saying he didn't want to go to jail. So it's a play on the word "shoot".

At least I think that's the joke. It's not a funny joke but I think that is what it is about.
