Hi all,

As you can see, I’m but a newbie on here, but I have a question for you..

If hypothetically I took a candid picture of someone, and I submitted it into a competition, if it was to win a prize or a cash prize, would the subject in the picture have a legal clam or could they sue for taking the picture without permission?

I only ask, because I was pondering the other day,
love to here your thoughts,
Cheers
Chris

P.S. really enjoying this forum, brilliant job people.

Cheers buddy, that satisfies my curiosity. now i can click away in the street without the fear of Reprisal.

If they are in a public place you're fine.

I have a follow on question
if you want to use it for commercial gain or advertising surely you need a model release if the shot is primarily of them

If it's advertising you will most likely need a model release - if it's for editorial use - you don't! :)

i thought about this as well
but most i take are abroad so the chances may be lower

i think there is a form you can get someone to sign etc model release
but if i was approached by a nerd with a form etc wanting a sig..i would ask to see the shot and then insist it was deleted
i think you have just to take candids in a way that the person cant claim you were actually taking their photo as a person...just in a scene...and not intending to embarrass them

there must be millions of transgressors of this situation

That's basically the long and short of it here in France.

iirc If it's for commercial use then you will need the subject to sign a release form
if it's just for personal use then it's fine although it may be good manners to tell them after taking the shot
