Yes, fast shutter speed and, on top of being a vertical dive, theit does look a little soft, maybe missed focus?

Nice catch Daniel I was at the park pond yesterday and the Gulls were swooping in like this dipping and swooped away again there was not enough light for bif though.

It would definitely be a keeper for me. I think it has a quality about it. My only criticism is that I would crop some of the water above the tail, that concentrates the mind on the Gull appearing to be kissing its reflection with the Gull and reflection filling the frame in an inverted triangle. It does not bother me that its not a conventional shot. I like it just my three pence worth.
