Edit My Images
No
I was invited to shoot at a conference, and i got a press pass for all its lectures/events. in return they asked for a CD of the pictures. Most pictures involved individuals, some are portraits of a single person.

My question is do i need permission from:

1. the event body

and/or

2. the individuals in the pictures

to show them publicly to others by means of facebook/online portfolio... etc?

is this just a matter of whether you're using them for profits? would that intention make a difference?

Thanks loads.

You own the copyright unless you agreed otherwise. Presumably you were paid for this work?

No, i wasn't paid.

So i see, I own the copyright of pictures I take.

Does that mean the event body will need my permission for them to publish my pictures? Am i entitled to claim any reproduction fees if they sell my pictures in prints?

if you negotiated this, then yes... if you said 'and I'll give you a cd of the photos and you can feel free to use them for whatever you want' then no...

not of my intention to make $$ out of it but I thought i should be equipped with some legal knowledge for the future.

Copyright and usage rights are two different things completely.

Owning copyright does not give your the right to use an image nor does it give you the right to transfer usage rights to another party.

The right to use an image may require releases (people and buildings) and if it contains trademarks or other copyright material (depending upon context within the image) may require releases from the trademark or other copyright holders.

Once you have usage sorted out then you can licence the use of the image to others as the copyright holder. You can of course licence others to use it without first sorting out property releases etc. (and leave yourself wide open to being sued) or you can licence its use with the agreement that the user seeks releases as necessary.

For most events a usual condition of entry is that you may be photographed or videoed and you consent to the use of these images.

Most event venues will include property releases (if asked) when hiring the venue. A property release is not usually needed if the property is not actually the subject of the image but is still part of the image.

Copyright and usage rights are complex and vary across the world. In general terms, in the UK you can publish the image in the context of editorial usage or to offer it for sale to the person/s featured.

I'm not a lawyer and all the above is my understanding after a lot of research but if you want to do it right then you need to book some time with someone who specialises and knows the law.

If you are in the UK you do not require any consent to show the images but you may need a model release to use the images commercially.
