I sold a lens here, and took some quite nice pics:

They now appear to be on an Ebay action!

http://cgi.ebay.co.uk/NIKON-NIKKOR-...14&_trkparms=72:1300|66:2|65:12|39:1|240:1318

I think the auction is from the lens purchaser:

I find the rudeness more annoying than anything, but they are my Copyright (even if they are just product images).

An e-mail asking if it was OK would have been nice...

eMail him stating how annoyed you, and I would be annoyed too. If you really wanna catch him out then send him a message through eBay asking if he took the pictures lol

tar and feather him

Evidence seems compelling, and the images are being used commercially.

If your phtoographs help sell the item then maybe you are due a percentage of the proceeds

Take a screen shot of the images on the eBay site (making sure the images are clearly identifiable so it can't be argued that they are different images to yours), and send him a bill, along with a copy of the screenshot.

You'll probably never get to see any money but it might just stop them from doing to someone else.

Image theft is image theft (large or small). AND if it is someone off here its even worse. They should know better. :nono:

Am I the only one who thinks everyone's making something out of nothing here, I fail to see how it's commercial, and unless you sold it for far less than you were asking he ain't going to be making anything out of it by the time he has paid the fee's, they are just some image's you took to help sell the lens, yes it would have been polite to ask but I really wouldn't have an issue with it if it they were mine.
If he had asked would you have said no ?

Yes, its the politeness thing. I would have thought that while it was being downloaded from my site and uploaded to Photobucket.. some common courtesy might have surfaced in-between :bonk:

If he had asked would you have said no ?

Actually tbh, I would rather an original image was taken.

I wouldn't have refused, but its lazy if you have the gear.

But then its lazy just nicking a pick without asking first...

I you contact ebay they are quite strict on this, they will pull the listing as it's against ebay rules. It's happened to me before.

I can understand you being annoyed.

I once sold a Nikon D2H on ebay then found someone else was using my images to sell theirs at the same time........I politely emailed the seller to advise of copyright to which he replied "I will consult my solicitor"

The image is being used to sell the item in question. That is using the image for a commercial purpose.

Yes, they may just be a couple of snapshots of the lens but so what; the images are being used without consent. The individual in question also knows who the photographer of the images is so it wouldn't exactly have been difficult to ask would it.

Nah, I woudn't do that.

I'm more annoyed "on principle" rather than anything else.

It's me, folks.

I have pulled the pictures and am very sorry for the inconvenience caused. These were uploaded in error and I am also cross with myself for not spotting it - will teach me to list these things when tired.

I have PM'd puddleduck and apologised.

Thanks,
James

P.S. Actually, I have just closed the auction as I wouldn't like to think that this mistake had led me to profit from someone else's pictures. Therefore the item has been ended and I will re-list it in the future with MY photos. Sorry once again.

No your not, i couldn't see any major problem in this, it's not like they where prize images that are going to win awards and i would have taken it as doing a fellow forum member a favor but i guess that's just me, anyway it seems to be resolved now so no further harm done to the owners pride, ;)

Hi

Well done for posting to say it was you. As far as I see it there has ben no harm done here and I am not sure the OP expected the listing to be removed.

But the issue is an interesting one. Are we to judge when the line is crossed. Here we are taking about a lens for a few pounds but say someone lifted a pic to advertise holidays or some real estate, in other words they make a lot of money. But then what is a lot of money. A million pounds is a lot to me but possibly not the same to Richard Branson.

I agree with the Mountain, Molehill bit. It's not a crime of the century, but I understand the principle. It's nice to be at least asked. :)

Looks like it was completely by mistake, and its nice to see that the chap has apologised for the mistake. I don't think the OP would have wanted the auction removed though :)

Good man. Faith in human nature restored!

Can't we tar and feather him anyway? it's years since I've been to a good tarring! ;)
